WizardVisions reserves the right to change policies, prices and
components of hosting plans without notice. If you use either the design
services and/or the hosting services, you agree to abide by our
policies. We reserve the right to cancel accounts at any time
for any reason.
BILLING POLICY
1. We require prepayment for all of our services. No
services will be rendered without prepayment. Failure to prepay
within your billing period will result in account deactivation without
notice.
2. We do not accept payment by
check, nor do we accept Discover cards.
3. You must provide a valid credit card
number and agree that we may charge that card quarterly and for any
editing requested by the client.
4. Or, you may sign up
for automatic monthly billing through a PayPal Subscription. All
editing fees will be requested through the PayPal
system.
5. As of June 1, 2001, there will be a $20.00 declined credit card fee
for rejected credit card numbers, with the exception of a decline due to
an outdated expiration date.
LATE FEES + NONPAYMENT
1. Late Fees - There will be a $20.00 late fee for EACH 30 days a
payment is late. So, if you're 60 days late, that's $40.00 and so
on!
2. We reserve the right to immediately
deactivate your account upon
nonpayment.
3.
We are not required to notify you of account deactivation. We will continue
to bill you until we receive your 30 day written cancellation notice.
Even if deactivated, your site will still be taking up space on our
servers and will still incur the quarterly charge until the site files
are removed from the server. Site files will not be removed
without written cancellation. By using our service YOU
AGREE TO PAY ALL ATTORNEY'S FEES IF WE HAVE TO INITIATE COLLECTION
PROCEEDINGS AGAINST YOU. YOU WILL BE REPORTED TO CREDIT
AGENCIES!!! So pay your bill and write the notice.
CANCELLATION POLICY
1. 30 Day WRITTEN CANCELLATION
POLICY: We require a thirty (30) day written notice of your intent to cancel.
If you we do not receive notice of your intent to cancel - in writing -
we will continue to bill you on a quarterly basis and take appropriate
steps to collect all debts owed to us. If you have an upcoming bill
and wish to cancel, but there are 30 or less days, notify us in writing
of your intent to cancel and we will prorate your next bill. You WILL
CONTINUE TO BE CHARGED if we do not receive a written
cancellation notice.
2. No refunds. You may cancel our services at any time with 30 days
written notice. However, if your quarterly bill has been paid, we accept
that payment as a commitment to do business with us for that quarter. If
you have paid for a specified period of time, you have committed
yourself to that specified period of time.
3. If your domain name has been cancelled by your domain registrar, YOU
WILL CONTINUE TO BE CHARGED by WizardVisions because your
files are still being stored on our servers. The files will not be
removed until we receive written notice of your intent to cancel. We
are not responsible for paying your domain name bill. You
are responsible for renewing your domain name on time.
TRANSFER POLICY (To
WizardVisions)
1. You are responsible for
transferring the files from your old server to our servers, unless
otherwise agreed upon. You should always have copy of your web site on
your computer or on disk.
2. Further, by using our service you warrant that
all files you have transferred are owned by you or your company, that you have the rights and permission to use
them, and that they are virus free.
TRANSFER POLICY (From
WizardVisions, Upon Cancellation)
1. After you have
hosted with WizardVisions for a period of two years, you are free at any
time to move your web site (and all files therein) to another hosting
service upon cancellation.
2. You are responsible for
transferring the files from our server to your new servers, unless
otherwise agreed upon.
3. If you would like
us to provide you with a copy of your entire web site on CD-ROM, and you
do not have any outstanding debt to WizardVisions, we will be happy to
do so for a charge of $35.
DEACTIVATION POLICY
1. We are not required to notify you of the disconnection. We will continue
to bill you until we receive your 30 day written cancellation notice.
Even if disconnected, your site will still be taking up space on our
servers and will still incur the quarterly charge until the site files
are removed from the server. Site files will not be removed
without written cancellation. By using our service YOU
AGREE TO PAY ALL ATTORNEY'S FEES IF WE HAVE TO INITIATE COLLECTION
PROCEEDINGS AGAINST YOU. YOU WILL BE REPORTED TO CREDIT
AGENCIES!!! So pay your bill and write the notice.
2. If your site is
deactivated, you will have 15 days to pay your bill in
full and reestablish your account in good standing. After the 15 days,
however, there will be a $50.00 reconnect fee to continue your service.
You will also be required to provide us with a valid credit card number
to be used for all additional services.
3. If your site is
not accessible because you have not paid the Domain registrar bill for
your Domain name renewal, we have to charge you $50.00 for the
reconnection of your web site.
DESIGN POLICY:
1. WizardVisions makes every effort to complete a site within four (4)
to five (5) weeks time. Our sites are often completed within two weeks.
However, we do not guarantee a set completion date, unless agreed to
before the start of a project. If your company does not supply us with
the necessary information within a reasonable time, we cannot move
forward on your site design. If we have advertised a time within which
we will complete a project, we will honor that time until the expiration
date noted on that particular advertisement.
2. After your company has been notified that your site is completed, you
will have 30 days to review and edit any information and graphics on
the site and make your first edit change requests. We will then
make the necessary changes within two weeks, free of charge.
3. After 30 days has passed since WizardVisions notified you that your
site is ready for review, you will either be charged the hourly editing
fee or you may take over editing the site yourself (free of
charge.)
EDITING POLICY:
1. You will be charged for any editing done by WizardVisions that
is not within your 30 day review period.
2. If you choose to
edit your web site yourself, you may do so free of charge.
However, you are required to follow our guidelines on disk space and
picture size limitation.
3. If you choose to
edit your own web site, WizardVisions is not required to maintain a copy
of your edited web site. Back-up copies of the server are
available to technical support personnel only and are not easily
accessible. However, we always maintain copies of the original web
site as we designed it. You are responsible for maintaining a back
up copy of your web site after you begin editing it.
4. Picture File
Size Limitation: Due to the popularity of digital cameras we are seeing an unnecessary
increase in the picture size that clients are uploading to their web
sites. Therefore, we are placing a picture size limit on all
pictures. You may not place any one picture or graphic that
is over 100k on your web site. All pictures must
be under 100k. You must make the necessary graphical adjustments
to compress your pictures and graphics before uploading. We
reserve the right to remove all pictures over this size limit.
PHOTO SESSION POLICY:
1. All photo sessions are a one-time session, one location only, and
must be within a 30 mile radius of either Springfield, Massachusetts or
Hartford, Connecticut. If we have to travel to your site again, you
will be charged the photo session fee. We photograph only one location
for the flat-rate design price. Photographing more than one location will
require us to bill you separately for EACH location. All
photographs and video tape use rights are held by Wizard Visions.
2. If a photo session must be cancelled, it may be cancelled ONE time
only. After that, you will be charged a $50.00 site fee or will be
required to supply your own pictures.
3. One photo session
is included in the flat-rate design price as a complimentary
service. If you choose not to take advantage of the photo session,
you will NOT receive a discount on your flat-rate design
package.
HARD DISK SPACE LIMITATION POLICY:
1. If you exceed the allotted megabyte limit for your package, you will be charged a minimum of $1.00 per megabyte
per month over the
allotted megabytes.
2. Please note that e-mail boxes
associated with your web site contribute to the hard drive space your
account takes up on our server. Please be conscious about the size
of your e-mail accounts. You will occasionally be reminded to
clean out your e-mail accounts.
VIDEO AND AUDIO STORAGE POLICY:
1. You may store video and audio on
your site. However, there will be an additional $10.00 per month fee for
the service up to 10 megabytes of storage and an additional charge for
excessive bandwidth usage may apply.
ILLEGAL CONTENT POLICY:
1. We do not host porn sites or sites with illegal content. Any such
sites will be immediately disconnected, no refunds will be issued and we
will not do further business with your company.
2. We do not host sites that educate in unnecessary violence, hate or
explosives. If we find such content on your site - even if it is a
hidden page - you will IMMEDIATELY be deactivated without refund.
3. YOU and your company are responsible for all copyright
violations. WizardVisions takes custom pictures and makes
custom graphics. Any pictures provided by you and/or your company
are your responsibility. You must own or have permission to use
any pictures provided to us. If you have offered those pictures to
us for use, you have warranted that you have the legal right to use
those pictures. If you aren't sure if you own the rights, then you
probably don't. Find other pictures or ask us what alternatives you have
for graphics.
TECHNICAL SUPPORT POLICIES:
1. Although we do provide technical support, we are not
"required" to provide extensive support on any programs. If
you are designing your own site, it is up to you to learn the program
that you are using. Any support provided by WizardVisions, either by a
WizardVisions employee or through our technical support pages, is a
complimentary service provided at our discretion.
2. Technical support is by e-mail ONLY. We do not accept phone-in
support calls, unless your e-mail is not working or you have made
specific arrangements with WizardVisions.
SEARCH ENGINE POLICIES:
As of the year 2002, we do not offer search engine submission as part of
any design package. You are responsible for submitting your site
to any and all search engines.
If we have offered Search Engine Submission with any of our design
packages the following limitations apply:
1. We are not responsible for where you end up in a search engine
search. 2. We are not responsible for changes you want made
to the search engine submission. 3. We are not responsible
for continued updating submissions. 4. You are responsible
for learning about search engine submissions and web marketing and
implementing your education yourself.
ADVERTISING YOUR DOMAIN:
1. We are not responsible, in any way, for advertising your domain name. We
are a web hosting and design company - not an advertising agency. If
your site is not getting 'hits', you should consider increasing your advertising efforts.
The clients that advertise their sites effectively have had
superior results. Those that haven't made an advertising effort haven't
had great success.
2. We reserve the right to use
screen shots of your web site in our design portfolio, both on and
offline.
